On May 5, the Central Committee of the Communist Party of China (CPC) and the State Council issued the Opinions on Establishing and Improving the System, Mechanism and Policy System for the Integrated Development of Urban and Rural Areas (hereinafter referred to as the Opinions), which lays out plans for the reform of the rural land system from the perspective of building a unified construction land market for urban and rural areas.
The highlight of the Opinions is that village collectives are allowed to convert unused homesteads and abandoned collective public welfare construction land for commercial purposes under the premise of farmers' voluntary participation.
According to a number of policies issued by the central government, the "nature" of collective ownership of rural land cannot be changed, the "agricultural use" of contracted land cannot be changed, and the "interests" of farmers should be fully protected, insisting that the size of the land should be large and the size of the land should be small.
According to the Opinions, on the premise of conforming to planning, use control and respecting the wishes of farmers, county-level governments are allowed to optimize the layout of village land, effectively utilize scattered and scattered construction land in rural areas, and allow rural collective construction land for business purposes to enter the city or be adjusted to enter the city in other places. Village collectives are allowed to convert the idle homestead recovered with compensation into collective construction land for business purposes under the premise of farmers' willingness. We will allow contiguous development areas such as villages in cities, villages near cities and village-level industrial parks to be brought to market in accordance with laws and regulations.
The problem of land use for tourism has long been attached importance to and concerned by all walks of life, and the difficulty of land use for rural tourism projects has been a hot spot in the industry in the past two years. If the enterprises engaged in cultural tourism project investment follow the normal process, the land should go through the "bidding, auction and listing", and take the demolition and reclamation fee of several hundred thousand yuan per mu as the standard, often tens of millions. The costly and time-consuming site target approval process has affected the progress of the project. At the same time, the traditional way of land supply cannot solve the problems of rural land supply, conversion of agricultural land, balance index of occupation and supplement, etc., so it is difficult for rural cultural tourism projects to be implemented, and the capital requirements are often too high, which makes investors shrink back.
